Federalism and Medical Marijuana

This section of RxCannabis.com is designed to help you understand Organic law and how it designed, fits in with industry and protects both consumers and “product”.

For the record, both the Federal and California State Government’s (as well as many other states) have rules and regulations with respect to term and use of “Organic”. Even so, its believed that none of those rules related to RX Cannabis. This lack of a definition allows unscrupulous vendors to take advantage of consumers, often fraudulently charging twice as much for product than they should, especially when they know that its not certified in any way, shape or form.

With that in mind, and after randomly checking with California’s organic certifiers (via phone), as of the creation of this page on 5/15/08, there are zero ‘strains’, growers or clubs that are certified to sell “certified organic cannabis” in the state of California (let alone the rest of the United States). That means that anyone who is selling product using an label that says ‘Organic’, is doing it for one reason: to rip the consumer off.

As a consumer advocate, I can honestly say that this industry is ripe with fraud and it starts with unlicensed/regulated businesses. As a responsible consumer, I strongly urge you to report this type of activity to the local DA for personal and medical fraud. And if you think you are doing something bad, simply remember this - professionalism will make this industry safe, effective and affordable for all that need it. According to testimony before the California State Assembly Revenue and Taxation Committee in 2007, a member of the Board of Equalization stated that out of about 500 clubs in the state, only 3 are licensed and pay taxes. Now of course, its over a year later - and we wonder how many more have become licensed, pay their taxes or simply comply with any consumer protection measures, laws or concepts? , 

With those facts in mind, www.RxCannabis.com is starting a program that is designed to clean up this problem by supporting two very specific goals:

  • CONSUMER EDUCATION: First, we plan on educating consumers, growers and clubs about the correct use of the term “ORGANIC”. With that in mind, we strongly urge consumers NOT TO PURCHASE ANY CANNABIS PRODUCT THAT IS DEFINED AS ORGANIC, BECAUSE THEY ARE NOT CERTIFIED BY ANY GOVERNMENTAL OR PRIVATE ENTITY, AND THUS ARE FRAUDULENT. This is not how a cannabis club should operate because its a disservice to their customer(s).
  • CERTIFICATION: Second, and just as important, we plan to work with growers and clubs to help establish organic certification programs that not only increase industry professionalism, but consumer awareness.
